1. Introduction

Welcome to CareJetty. These Terms and Conditions (“Terms”) govern your use of the CareJetty mobile application (the “App”) and website (the “Site”), collectively referred to as the “Platform.”

By accessing or using CareJetty, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

“CareJetty” (or “we”, “us”, “our”) refers to [Company Name Ltd], a company registered in England and Wales under company number [Number], with its registered office at [Address].

2. Nature of the Platform

2.1 Introductory Agency: CareJetty acts as an introductory platform that connects those seeking care (“Care Seekers”) with self-employed care professionals (“Carers”) and registered care agencies (“Agencies”).

2.2 Not a Care Provider: Unless explicitly stated otherwise, CareJetty is not a domiciliary care provider. We provide the technical infrastructure to facilitate connections, bookings, and payments. The contract for care services is formed directly between the Care Seeker and the Carer (or Agency).

2.3 Employment Status: Independent Carers on the CareJetty platform are self-employed professionals, not employees of CareJetty. They are responsible for their own tax and National Insurance contributions.

3. User Eligibility and Accounts

3.1 Registration: You must be at least 18 years old to use the App. You agree to provide accurate, current, and complete information during the registration process.

3.2 Vetting:

  • Carers: To list your services, you must pass our vetting process, which includes Identity Checks, Right to Work in the UK, and an Enhanced DBS check.

  • Agencies: You must provide proof of valid CQC (Care Quality Commission) registration and appropriate insurance.

3.3 Security: You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately of any unauthorized use of your account.

4. Terms for Care Seekers

4.1 Safety: You agree to provide a safe working environment for Carers visiting your home. You must disclose any known risks (e.g., infectious diseases, aggressive pets, structural hazards) prior to the visit.

4.2 No Poaching: You agree to handle all bookings and payments with CareJetty Carers exclusively through the Platform for a period of [e.g., 12 months] from the initial introduction. Paying Carers “cash in hand” off-platform is a violation of these Terms and creates safety and insurance risks.

5. Terms for Care Professionals

5.1 Professional Standards: You agree to deliver care services with reasonable care and skill, adhering to industry standards and the CareJetty Code of Conduct.

5.2 Insurance: While CareJetty may provide a contingent Public Liability Insurance policy for bookings made through the App, you are encouraged to hold your own professional insurance.

5.3 Accuracy: You warrant that all qualifications, training certificates, and background check documents provided to us are genuine and up to date.

6. Bookings, Fees, and Payments

6.1 Service Fees: CareJetty charges a Service Fee for the use of the Platform. This fee is clearly displayed before a booking is confirmed.

  • For Seekers: A service fee is added to the hourly rate.

  • For Carers: A commission may be deducted from your earnings.

6.2 Payment Processing: Payments are processed via a secure third-party payment provider (e.g., Stripe). Care Seekers are charged upon completion of the visit (or in advance, depending on app settings).

6.3 Direct Payments: If funding care via Local Authority Direct Payments or NHS Personal Health Budgets, you are responsible for ensuring our invoices meet your funder’s requirements.

7. Cancellations and Refunds

7.1 Cancellation Policy: Bookings can be cancelled via the App.

  • Cancellations made more than [24 hours] before the visit are fully refundable.

  • Cancellations made within [24 hours] may incur a cancellation fee to compensate the Carer.

7.2 Refunds: Refunds for substandard service are handled on a case-by-case basis via our Dispute Resolution Centre.

8. User Conduct and Content

8.1 Reviews: Users may leave reviews for Carers. You agree that your reviews will be truthful, constructive, and free from abusive or discriminatory language.

8.2 Prohibited Acts: You may not use the Platform to:

  • Discriminate against any user based on race, religion, gender, disability, or sexual orientation.

  • Solicit users for services outside of CareJetty.

  • Harass, abuse, or harm another person.

9. Limitation of Liability

9.1 Platform Role: To the extent permitted by law, CareJetty is not liable for the acts, omissions, or quality of care provided by Independent Carers or Agencies.

9.2 Cap on Liability: Our total liability to you for any claim arising out of or relating to these Terms or the use of the App is limited to the amount of Service Fees paid by you in the 12 months preceding the claim.

9.3 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud.

10. Termination

We reserve the right to suspend or terminate your account immediately, without notice, if you violate these Terms, fail a background check renewal, or if your conduct poses a risk to our community.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
